By navigating in this area, the user accesses the Pygmenta website via the link: Pygmenta.com. Browsing and placing an order on the website imply acceptance of the Conditions and Data Protection Policies adopted by the site.
These General Terms and Conditions of Sale apply to the sale of products exclusively for purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code (Legislative Decree No. 206/05 amended by Legislative Decree No. 21/14 and Legislative Decree No. 70/03) by the company:

Hereinafter referred to as: Pygmenta.
The user must read these General Terms and Conditions of Sale before accessing the products provided by the site, as their acceptance is general and unequivocal upon purchase. We recommend that the user download and print a copy of the purchase form and these General Terms and Conditions of Sale, whose terms Pygmenta reserves the right to unilaterally modify without notice.
Art. 2 – Purpose
These General Terms and Conditions of Sale govern the offer, submission, and acceptance of purchase orders for products on pygmenta.com and do not regulate the provision of services or the sale of products by third parties present on the same site through links, banners, or other hypertext connections. We suggest checking their terms of sale before placing orders and purchasing products and services from entities other than Pygmenta.
Art. 3 – Conclusion of the Contract
To conclude the purchase contract, the user must fill out the form in electronic format and send it following the relevant instructions. It contains a reference to the General Terms and Conditions of Sale, images of each product and its price, payment methods available, methods for delivering purchased products and related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, and methods and timeframes for returning purchased products.
Before concluding the contract, the user will be asked to confirm that they have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and the processing of personal data.
The contract is concluded when the seller receives the completed form from the user, after verifying the accuracy of the data contained therein. The user will be obliged to pay the price once the online order submission process is complete. This will occur by clicking the "Pay Now" button at the end of the guided procedure.
Once the contract is concluded, the seller takes charge of the order for its fulfillment.
Art. 4 – Registered Users
When completing the registration procedures, the user agrees to follow the instructions on the site and provide their personal data correctly and truthfully. The confirmation releases Pygmenta from any liability regarding the data provided by the user.
The user agrees to promptly notify Pygmenta of any changes to their data at any time. If the user provides inaccurate or incomplete data or if there are disputes regarding payments, Pygmenta reserves the right not to proceed with the order or to suspend the shipment of goods until the defects are resolved.
When the user requests profile activation for the first time, Pygmenta will assign a username and password to the profile. These identifiers are considered the system for validating user access to the Services and the only system suitable for identifying the user. All acts performed through such access will be attributed to the user and will have binding effect on them.
The user agrees to keep their access credentials confidential and to safeguard them with due care and diligence, not transferring them, even temporarily, to third parties.
Art. 5 – Product Availability
Product availability refers to the actual availability at the time the user places the order. However, this availability should be considered purely indicative because, due to simultaneous presence on the site of multiple users, products may be sold to other customers before the order confirmation.
Even after sending the order confirmation email, partial or total unavailability of goods may occur. In such cases, the order will be automatically corrected by canceling the unavailable product, and the user will be promptly notified by email. If the user requests order cancellation following this communication, resolving the contract, Pygmenta will refund the amount paid within 14 days from when Pygmenta becomes aware of the buyer's decision to resolve the contract.
Art. 6 – Products Offered
Pygmenta offers a wide range of specialized items for scalp micropigmentation, including high-quality pigments for scalp treatments. Our offer also includes scalp care products ideal for maintaining optimal skin condition after treatments. Additionally, we provide a line of branded merchandise, including T-shirts and hoodies with the Pygmenta logo, perfect for customers who want to incorporate our brand into their daily lives. Art. 7 – Payment Methods and Prices
The product price will be the one indicated on the site at the time of the order, except in cases of evident error. In case of error, Pygmenta will notify the buyer as soon as possible, allowing them to confirm the order at the correct price or cancel it. In any case, Pygmenta will not be obliged to supply the sold item at the erroneously indicated lower price.
Prices are expressed in various currencies for a better user experience, excluding VAT, customs duties, and shipping costs. Prices are subject to change at any time. Modifications will not affect already completed orders.
Payment methods include: Credit Cards, Debit Cards, PayPal, Apple Pay, and Google Pay.
Art. 8 – Delivery
Pygmenta ships to over 50 countries. Before placing an order, shipping costs can be viewed by selecting the correct country on the checkout page. Delivery occurs generally within 30 days unless otherwise specified.
Art. 9 – Transfer of Risk
The risk associated with the products transfers to the buyer upon delivery. Ownership of the products is considered acquired as soon as full payment of all amounts due for the products, including shipping costs, has been received, or at the time of delivery, if this occurs later.
Art. 10 – Warranty and Commercial Conformity
Pygmenta is responsible for any defects in the products offered on the website, including the non-conformity of the products to the ordered items, in accordance with Italian law.
If the buyer has entered into the contract as a consumer, that is, any individual acting on the site for purposes unrelated to their business or professional activity, this warranty applies provided that:
In case of non-conformity, the consumer who has entered into the contract has the right to have the products brought into conformity free of charge, to obtain their replacement, to request an appropriate price reduction, or to terminate the contract concerning the disputed goods and obtain a refund for the price paid.
All return costs for defective products will be covered by Pygmenta.
Art. 11 – Right of Withdrawal
In accordance with current legislative provisions, the buyer has the right to withdraw from the purchase without penalty and without specifying the reason within 14 (fourteen) days under Article 57 of Legislative Decree No. 206/2005, starting from the delivery date of the products.
For multiple purchases made by the buyer in a single order but delivered separately, the 14-day period starts from the delivery date of the last product.
To exercise the right of withdrawal, the user may send an email indicating the buyer’s name, order number, and order date to pygmentaink@gmail.com.

The goods must be returned intact, in their original packaging, complete in all parts, and including attached documentation. Subject to verification of compliance with the above, Pygmenta will refund the price of the returned products within 14 (fourteen) days.
Shipping costs will be borne by the customer. If the order was subject to a promotion with free shipping, the return shipping costs will still be charged to the customer.
As per Article 56, Paragraph 3 of Legislative Decree No. 206/2005, as amended by Legislative Decree No. 21/2014, Pygmenta may withhold the refund until receipt of the goods or until the buyer has demonstrated having sent back the goods.
Art. 12 – Data Processing
The buyer’s data is processed in accordance with the provisions of the legislation on personal data protection, as specified in the relevant section containing the information pursuant to Article 13 of the European Regulation 2016/679 (Privacy Policy).
Art. 13 – Severability Clause
In the event that any clause of these General Terms and Conditions of Sale is declared invalid for any reason, this will not compromise the validity and enforceability of the other provisions contained herein.

These General Terms and Conditions of Sale are governed by and interpreted in accordance with Italian law, subject to any other mandatory rules prevailing in the buyer’s country of habitual residence.
Consequently, the interpretation, execution, and resolution of the General Terms and Conditions of Sale are subject exclusively to Italian law. Any disputes related to and/or arising from these conditions must be resolved exclusively by the Italian judicial authorities.
If the user is a consumer, any disputes must be resolved by the court in the user’s place of residence or domicile under applicable law.
